Chapter 1. Refraining From Harming One Who Says: Laa Ilaaha Illallaah
3927. It was narrated from Abu Hurairah that the Messenger of Allaah, sall'Allaahu alayhe wa salaam, said: "I have been commanded to fight the people until they say: Laa ilaaha illallaah. If they say it, then their blood and wealth are protected from me, except for a right that is due from it, and their reckoning will be with Allaah." [Sahih]
a. Everyone who pronounces the fundamental word of Islaam (Laa ilaaha illallaah and Muhammadur-Rasulullaah), all the rulings of Islaam applies to him in the world. If he does not have faith in his heart he will be punished in the Hereafter.
b. 'Blood and wealth are protected' means that they are not killed by waging war against them, and their property is not taken as booty or Fai' (ie booty gained without fighting).
c. 'Except for a right' means punishing them for their crimes such as cutting off the hand of a thief, and flogging those who accuse chaste women of adultery, killing someone as punishement for murdering an innocent person, etc. 'Except for a right' also means forcing them to give Zakaah and paying the obligatory expenses, collecting the blood money for an intended murder with the agreement of the heirs of the one who is killed, and demanding the blood money from the murderer or his tribe in an accidental killing, with the agreement of the heirs of the one who is killed, etc.

We mention this in connection with marriage for the following: Punishment is for disobedience to Allaah subhana wa ta'alaa, and for disobedience to His Messenger, sall'Allaahu alayhe wa salaam. All else is minor, and is sometimes only a matter of personal preferences. In all cases, investigating, talking, explanations by both parties preceeds all else; it may be that the person does not know that what they did was incorrect, Islaamically, and we have been commanded to think good of the Muslims, and to make excuses for them. There is no reason for a man to yell at his wife or threaten her if she does not cook breakfast to his liking.
